Nebraska Man Wins Back Home After Losing It Over $588 Tax Debt

In a landmark resolution, Kevin Fair of Scottsbluff, Nebraska, is regaining the title to his home after a lengthy legal battle stemming from an unpaid $588 property tax debt. Fair, who owned the home for nearly 30 years, lost its title in 2018 after Scotts Bluff County sold the tax lien to a private investor as permitted by Nebraska law at the time.

When Fair was unable to repay the debt, including interest and fees, the property title transferred to the investor. However, Fair was allowed to stay in the home while the legal dispute unfolded.

The Nebraska Supreme Court initially ruled against Fair in 2022. However, the U.S. Supreme Court intervened in 2023, instructing the state court to reconsider the case. In August 2023, the Nebraska Supreme Court reversed its earlier decision, declaring that Fair should retain ownership of his home.

Fair’s legal team, the Pacific Legal Foundation, announced on Thursday that the dispute between Fair and the investor has been amicably resolved. Christina Martin, a senior attorney at the firm, emphasized that the case established a critical precedent: home equity is constitutionally protected.

“For Kevin, this ruling means the difference between having a home and likely facing homelessness,” Martin said.

The emotional toll on Fair has been significant. His wife passed away in 2019, and he suffered a stroke last month. A GoFundMe campaign has raised nearly $10,000 to support modifications to his home, such as building a ramp to accommodate his mobility needs.
